Terms and Conditions of Service

1. Acceptance of Terms

Welcome to Jobmio. These Terms and Conditions of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Vinnogro("Company", "we", "us", or "our"), governing your access to and use of the Jobmio web application (https://app.jobmio.app), marketing website (https://jobmio.app), "Save to Jobmio" browser extensions, application programming interfaces (APIs), and associated career services (collectively, the "Service").

By creating an account, accessing, or using any part of the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility & Account Security

2.1 Age Requirement

You must be at least sixteen (16) years of age (or the legal age of majority in your jurisdiction) to use Jobmio. By using the Service, you represent and warrant that you meet this requirement.

2.2 Account Registration

To access core features of Jobmio, you must register for an account using Google Sign-In or email and password authentication managed via Google Firebase Authentication. You agree to provide accurate, current, and complete information and keep it updated.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify us at support@vinnogro.com of any unauthorized access or security breach. Vinnogro is not liable for any loss or damage arising from your failure to protect your login credentials.

3. Description of Service

Jobmio is an AI-powered personal career coach and application management platform designed to streamline the job search process. Key capabilities include:

• Career Repository & Profile Management: Centralized storage of employment histories, quantified achievements, education, credentials, and career goals.
• Application Tracker: Visual status management across six pipeline stages (Wishlist, Applied, Interviewing, Offered, Closed, On Hold).
• AI Document Tailoring: Tailoring resumes and cover letters using large language models (LLMs) based on specific job postings, with customizable formatting and DOCX/PDF export.
• "Save to Jobmio" Browser Extensions: Client-side DOM parsing tools that capture job advertisements from third-party career portals and assist in populating application forms.
• Public Recruiter Portfolios: Generation of tokenized, shareable candidate profiles (/portfolio/[token]) showcasing verified achievements and credentials.
• Interview Calendar & Availability Scheduling: Interactive booking tools enabling prospective employers and recruiters to schedule interviews directly.
• STAR Mock Interview Preparation: Generation of role-specific interview preparation guides and structured Situation, Task, Action, Result responses.
• Multi-Platform Job Search Synchronization: Search query construction across eight major job discovery boards.

4. User Content & Intellectual Property Ownership

4.1 100% User Ownership

You retain full, exclusive intellectual property ownership of all career data, employment histories, resumes, cover letters, portfolio customizations, and job application notes that you upload, submit, or generate through the Service ("User Content"). Vinnogro claims no ownership or title to your User Content.

4.2 Limited License to Vinnogro

You grant Vinnogro a non-exclusive, worldwide, royalty-free, limited license to host, store, transfer, display, and process your User Content solely to the extent necessary to provide, maintain, and operate the Service for you.

4.3 AI Training Protection

We do not use your User Content to train public foundation artificial intelligence models. Your career data is never sold to data brokers, ad networks, or third-party recruiters without your express consent.

5. Subscriptions, Payments & Billing

5.1 Free and Pro Tiers

Jobmio offers both a Free Tier and a paid Pro Subscription Tier:

• Free Tier ($0.00): Basic job tracking, profile management, and essential application tools.
• Pro Tier ($20.00/month or $192.00/year): Advanced AI resume tailoring, multi-resume smart merge, unlimited custom portfolio tokens, full interview prep guides, and priority AI processing.

5.2 Payment Processing via Stripe

All subscription payments, renewals, and card details are securely handled by our third-party payment processor, Stripe, Inc. Vinnogro does not store or process your complete credit card numbers. By purchasing a Pro subscription, you authorize Stripe to charge your designated payment method for all applicable recurring fees.

5.3 Automatic Renewal

Subscriptions automatically renew at the beginning of each billing cycle (monthly or annually) unless cancelled before the renewal date. You may cancel your subscription at any time via the billing management portal inside Jobmio Settings or by contacting support@vinnogro.com.

5.4 Cancellation & Refund Policy

Try Before You Buy (Free Tier): Jobmio provides an ongoing Free Tier with no credit card required so you may thoroughly evaluate the features, interface, and compatibility of the Service prior to purchasing a paid subscription.

No Change-of-Mind Refunds: Because the Service delivers immediate digital access and initiates real-time artificial intelligence processing upon purchase, subscription fees are non-refundable once billed. To the maximum extent permitted by applicable law (including European Union Directive 2011/83/EU, Article 16(m)), you acknowledge and agree that digital service execution begins immediately and you waive any statutory cooling-off or right of withdrawal period once access is provided.

1-Click Self-Service Cancellation: You may cancel your subscription at any time with one click through the billing customer portal in your Jobmio account settings, or by emailing support@vinnogro.com. Cancellation takes effect at the conclusion of your current prepaid billing cycle, and you will not be billed again.

Statutory Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any statutory rights or consumer guarantees that cannot be lawfully excluded under the Australian Consumer Law (contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable consumer protection legislation. In the event of a major service failure that cannot be remedied, you retain all statutory remedies provided by law.

5.5 Fair Use Policy

Jobmio Pro subscriptions are intended exclusively for individual, personal job seeking. To safeguard model availability, maintain low latency, and prevent commercial reselling, Pro accounts are subject to a Fair Use Safety Threshold of 500 AI operations per calendar month and up to 200 active tracked applications. Accounts exceeding these thresholds through automated bot scripting or multi-user sharing may be throttled or suspended.

6. Acceptable Use Policy & Prohibited Conduct

You agree not to use Jobmio to:

1. Reverse engineer, decompile, disassemble, or extract source code from the Service.
2. Resell, rent, sublicense, or commercially exploit Jobmio services to third parties.
3. Deploy automated scrapers, crawlers, bots, or unauthorized scripts to bypass rate limits or harvest data.
4. Attempt to circumvent authentication, exploit API vulnerabilities, or disrupt infrastructure.
5. Upload viruses, malware, or malicious code.
6. Submit fraudulent, deceptive, or misleading work history intended to perpetrate employment fraud.
7. Harass, abuse, or violate the intellectual property rights of any person or entity.

7. Public Portfolios & Recruiter Availability Links

Jobmio enables you to generate public tokenized links (/portfolio/[token] and /availability/public). You acknowledge that:

• Anyone with access to your tokenized URL will be able to view the career highlights, credentials, and availability slots you have elected to display.
• You may revoke, regenerate, or disable your public portfolio tokens at any time through your Jobmio account settings.
• Vinnogro is not responsible for any subsequent dissemination of your portfolio by third parties who have received your link.

8. Third-Party Job Boards & Integrations

Jobmio integrates with and provides link generation for independent third-party job search platforms, including Seek, Indeed, LinkedIn, Google Jobs, Glassdoor, Wellfound, RemoteOK, and Jora. You acknowledge that:

• Jobmio is an independent productivity platform and is not affiliated with, sponsored by, or endorsed by any of these third-party platforms.
• Your interactions with third-party job postings, application submissions, and career portals are governed by the respective terms and privacy policies of those external entities.

9. AI Output Disclaimers & Candidate Verification Duty

9.1 Non-Deterministic Outputs

Jobmio utilizes artificial intelligence algorithms and large language models (including Google Gemini, OpenAI, and OpenRouter APIs) to generate document recommendations, summary bullet points, and interview suggestions. AI outputs are non-deterministic and may occasionally produce inaccuracies, omissions, or stylistic mismatches.

9.2 Candidate Verification Duty

You bear sole responsibility for reviewing, fact-checking, and editing all AI-generated content (including resumes, cover letters, and screening answers) before submitting them to any employer, recruitment agency, or third party. You must ensure that all representations regarding your skills, qualifications, and employment history are truthful and accurate.

9.3 No Employment Guarantees

Jobmio is a software tool designed to assist your job search. Vinnogro makes no guarantees, warranties, or representations that using Jobmio will result in job interviews, job offers, or employment. Hiring decisions rest entirely with prospective employers.

10. Disclaimer of Warranties ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. VINNOGRO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VINNOGRO, ITS DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR EMPLOYMENT OPPORTUNITIES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO VINNOGRO FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless Vinnogro, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your User Content; or (c) your violation of any third-party rights or applicable laws.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New South Wales, Australia.

14. Modifications to Terms & Service

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this document and notify active users via email or an in-app banner. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance.
